Investigating the Causes, Resolving the Claims

AViCON is set to return to New York April 25 of 2012. This highly successful case study format is gathering reputation and recognition on both sides of the Atlantic. AViCON will be of interest to anyone involved in aviation insurance — underwriters, claims managers, lawyers, risk managers, insurance brokers, airline flight safety directors, airline board members with flight safety responsibility, claims investigators, and aircraft product manufacturers.
Taking just one day, the 2012 conference is based on a reconstruction of a fictional air disaster when a passenger aircraft crashes off the runway in bad weather. Causation is far from clear, and a number of parties may have contributed to the accident. The conference will show how such a disaster may be investigated and managed; it then goes on to illustrate the complex legal issues involved and the strategies that may be employed in settling the claims.

The case study will be presented with state-of-the art video and graphics created by RTI’s visual media consulting group. Speakers and delegates move along the timeline of an accident investigation, to legal discovery, multi-party litigation, and resolution.

Previous AViCON events have addressed scenarios for a new entrant airline, and buying a new technology airframe that suffers a survivable failure to an engine. This year's scenario revolves around a failure that subsequently results in multiple fatalities due to a range of issues, including:
All are set within an environment that includes many possible choices of forum and law. The 2012 accident scenario will be presented with state-of-the-art animation prepared by RTI's Magic Motion Studios, and will highlight a fresh set of complex issues of current concern and debate within the aviation market. This event presents a unique opportunity for all those concerned with safety in aviation to gain a fuller understanding of the entire range of complexities involved in an aviation accident, in a concise and effective format.
After viewing the animated case study, experts in disaster management and accident investigation will lead the audience through the technical aspects of crisis management and the process and protocols of a formal investigation.
The circumstances shown in the video lead to potential liability for a number of parties, including the airline, the aircraft manufacturer, and the maintenance contractor. A group of leading lawyers will debate the issues that arise, including: forum selection, punitive damages, fee considerations, evaluating claims, negligent entrustment, discovery, spoliation, dispute resolution, quantum of damages, and relationship with insurers.

REFUND/CANCELLATION POLICY:
Registrants who cancel their registration and do not attend AViCON will receive the events materials via U.S. Mail following the event. These registrants will also receive a letter entitling them to a credit to be used when registering for a future AViCON event. The credit will be in the amount of the registration fee paid, less $150 for the cost of materials and administrative expenses. Registrants must present the letter prior to a future registration in order to redeem the credit. The event assumes no responsibility for maintaining records of cancellations or credited sums.

In 1998 RTI first produced AViCON, in conjunction with Lloyds of London, to a full house of applauding delegates. Since then the event has been re-scripted numerous times and presented in both London and New York. AViCON was conceived as a challenging and yet fictitious fact-rich animation scenario of a major commercial aircraft casualty to provide for an open exchange of reasoning and strategies practiced to resolve such complex claims, but not normally exchanged among the legal and insurance professions.
Today AViCON is produced by RTI to engage a wider audience with a distinguished faculty of investigators, lawyers, and insurance underwriters, using topical fact patterns demonstrated with high resolution animated scenarios.
Could anyone imagine a more perfect venue for an AViCON event than on board the historic Intrepid aircraft carrier where the view from the stern is just a short distance from the spot where Sully’s aircraft came to a stop and floated on the Hudson River. The Intrepid is also home to a retired BA Concorde.

Tim Scorer specializes principally in aviation claims and aviation insurance disputes, litigation, and arbitration and mediation for Ince & Co. He handles a wide range of aviation interests including aircraft operators and pilots, aircraft manufacturers, airlines, flying displays, airports and aerodromes, certification authorities, helicopters, gliders, micro-lights, hang gliders, parachuting, and balloons. Mr Scorer represents and assists in claims involving the interests of aviation industry organisations and the domestic and international aviation insurance market which provides coverage for them. He advises on contractual, insurance, and aviation regulatory matters, and represents clients in litigation, arbitration and mediation, fatal accident inquests, and in relation to aviation criminal cases. Mr. Scorer has participated in numerous mediations covering a wide variety of disputes in the aviation legal environment.
Drawing on his professional and practical experience, Mr. Scorer is a lecturer and speaker at courses, conferences, seminars, and symposia on a wide range of legal issues affecting the aviation industry, particularly airworthiness, airport operations, carriage by air, air operations, and general aviation legal liabilities. For more than thirty-five years, he has been closely involved in the general aviation industry both professionally and socially. Having qualified as a private pilot in 1972 and accumulated over 1200 hours in single-engine aircraft, Mr. Scorer brings a high degree of technical and practical knowledge to his work.
